PeliFlo SMS/Messaging Terms
This document has two parts:
- Part A, Terms for Shops: the rules a Shop agrees to when it sends texts and emails through PeliFlo. Part of the PeliFlo Terms of Service.
- Part B, Text Message Terms for Clients: the public terms shown to people who sign up to get texts from a Shop. Written to be linked in each Shop's 10DLC campaign registration and on its booking page.
PeliFlo is operated by The Fly Pelican LLC ("TFP"), 7040 Seminole Pratt Whitney Rd #25-166, Loxahatchee, FL 33470.
Part A: Terms for Shops
A1. You are the sender
- Texts sent through PeliFlo are sent on your behalf, as your business. TFP provides the software and works with a messaging provider to deliver them.
- Each Shop texts from its own number under its own 10DLC brand and campaign registration with US carriers. Registration is filed in your business's name.
- You must give accurate business details for registration (for example, legal business name, address, EIN or other ID the carriers require, website and contact details). False details can get your registration rejected or your number shut off.
- Registration is not guaranteed. Carriers and the campaign registry decide whether to approve your brand and campaign, and can change limits or suspend sending. Texting may not start until approval is complete, which can take days or weeks.
- TFP pays the carrier and 10DLC fees for your shop's registration (for example, brand registration, campaign vetting and monthly campaign fees). You don't pay them separately.
- The Shop owns its texting number. The phone number assigned to the Shop for texting belongs to the Shop.
A2. Two kinds of texts
| Kind | Examples | Consent needed |
|---|---|---|
| Appointment (transactional) texts | Booking confirmations, reminders, changes, waitlist or "your chair is ready" alerts | The client gave their mobile number for the appointment and agreed to get appointment texts |
| Marketing (promotional) texts | Specials, discounts, "we have openings today," re-booking nudges, birthday offers | Separate, express written consent to get marketing texts (for example, an unchecked box the client ticks, with the required disclosures) |
Operational texts are the same on every plan: confirmations, reminders, reschedule and cancel notices, fee links and line texts. Automated re-booking nudges and birthday offers count as marketing texts and draw from your text balance.
A3. Your consent duties
You must:
- Get consent before texting. Only text people who gave you their number and agreed to the kind of texts you send. Marketing texts need separate express written consent, and agreeing to marketing can't be a condition of booking or buying.
- Use PeliFlo's consent screens (or equal wording) so the required disclosures are shown: program name, what texts they'll get, message frequency, "Msg & data rates may apply," "Reply STOP to opt out, HELP for help," and links to the Text Message Terms and Privacy Policy.
- Keep proof. If you collect consent outside PeliFlo (for example, a paper form), keep a record of who agreed, when, how and to what. Do not upload numbers to PeliFlo for marketing unless you have this proof.
- Never buy, rent or share contact lists, or text numbers scraped from the internet.
- Honor opt-outs right away. PeliFlo processes STOP and similar replies automatically. If a client opts out another way (in person, by phone, by email, or by writing "stop texting me"), mark them opted out in PeliFlo right away.
- Respect quiet hours. Don't send marketing texts outside 8 a.m. to 8 p.m. in the recipient's local time and follow any limit on how many marketing texts one person may get per day.
- Follow the law and carrier rules, including the federal Telephone Consumer Protection Act (TCPA), the Florida Telephone Solicitation Act, CTIA guidelines, and carrier 10DLC policies.
A4. Content rules
Do not send texts or emails about: illegal drugs or cannabis, alcohol or tobacco/vaping promotions, firearms, gambling, adult or sexual content, loans or debt relief, hate or harassment, phishing or fake links, or anything else carriers forbid. Don't use public link shorteners that carriers block. Every marketing text must say who it is from (your shop name).
A5. Text allowances, text packs and pacing
- Operational texts are unlimited on every plan, subject to fair use. These are booking confirmations, reminders, reschedule and cancel notices, fee and payment links, and line (waitlist) texts. Fair use means normal use for running your shop. If your volume is far above normal for a shop your size, or looks like abuse, we may contact you and ask you to change how you use texting.
- Marketing texts (blasts) draw from your text balance. Your balance is made of:
- your plan's monthly marketing allotment, if your plan includes one. It resets each month, and unused allotment texts don't roll over; and
- text packs you buy.
- Text packs: any plan can buy them anytime, as one-time purchases: 250 texts for $10, 500 for $15, or 1,000 for $25. Pack texts expire 90 days after purchase and are non-refundable, including unused texts and texts left when your account closes.
- Pacing: to protect your clients and your carrier registration, PeliFlo sends no more than about 2 marketing texts per client per week. Marketing texts to a client who has hit the limit are held back. In practice, PeliFlo sends no more than 2 marketing texts to the same client in any rolling 7 days.
- No overage charges. When your text balance runs out, marketing blasts pause until your allotment resets or you buy a pack. Operational texts keep sending.
- A text longer than one standard segment, or with emoji or special characters, may count as more than one text.
- We may pause marketing sending if your sending looks like abuse. We will not intentionally block operational texts because your marketing balance is empty.
A6. Email
- Emails go out through PeliFlo's email sending service, from an address set up for your shop.
- Marketing emails must follow CAN-SPAM: honest "from" and subject lines, your shop's physical address, and a working unsubscribe link. Honor unsubscribes within 10 business days (sooner is better).
- Don't email people who didn't give you their address or who unsubscribed.
A7. What TFP may do
To protect carriers, recipients and other shops, we may: review message content, block or delay messages, pause your texting or email, or end it, if we believe you're breaking these rules, if a carrier or our messaging provider asks, or if we receive complaints. We will tell you when we can.
A8. Responsibility
You are responsible for your contact lists, consent records and message content, and you indemnify TFP as described in Section 17 of the Terms of Service. We are not responsible for messages that carriers delay, filter or don't deliver.
Part B: Text Message Terms for Clients
Program. When you give your mobile number to a shop that uses PeliFlo (the "Shop") and agree to get texts, you'll get text messages from that Shop. The texts are sent through PeliFlo, a booking software service by The Fly Pelican LLC, on the Shop's behalf. The program name is the Shop's name (for example, "[Shop Name] Appointments").
What texts you may get.
- Appointment texts: booking confirmations, reminders, changes and cancellations, and waitlist updates.
- Marketing texts (only if you also agree to them): special offers, openings and news from the Shop.
How you sign up. You agree to get texts by ticking a box or confirming when you book online, join a waitlist, or sign up at the Shop. Agreeing to marketing texts is not required to book or buy anything.
Message frequency. Message frequency varies. Appointment texts are usually sent when you book and before your appointment. Marketing texts (only if you agreed to them): up to 2 messages per week.
Costs. Message and data rates may apply. Check your mobile plan for details.
Opt out. Reply STOP to any message to stop getting texts from that Shop. You'll get one message confirming you're unsubscribed, and no more texts after that. You can also reply STOPALL, UNSUBSCRIBE, CANCEL, END or QUIT, or tell the Shop another way. To rejoin, reply START.
Help. Reply HELP for help, or contact the Shop directly at the phone number on its booking page. You can also contact PeliFlo at support@peliflo.com.
Carriers. Carriers are not liable for delayed or undelivered messages.
Privacy. We and the Shop use your information as described in the PeliFlo Privacy Policy. Mobile numbers and text-message consent are not shared with third parties or affiliates for their marketing or promotional purposes. Your information is shared only with service providers that help deliver the messages.
Changes. We may update these terms. The current version is always at this page.
